Legally established companies Wibotex S.A & Syhpax Special Confection (Ex-W.B.S) emloyed 420 Tunisien workers. The factory is/was located in the free zone area and benefited from the rights arising their status as 100% exporter (loi-72) since their inception on 1987&1973 respectively.
The companie S.S.C.S.A.(Ex-WBS) is/was prorietaire of 6671 m land and factory in Sfax.(Picture)
The production machine park contained 614 sewing machines. Collaboration with important European defence administrations testifies degree of manufacturing capacity. The companies enjoyed the quality system RFA-AQUAP4 and got it’s İSO-9002 certificate in 1995.
The companies has been known for many years of prosperity, employing up to more than 500 workers and subcontractors by the tenders obtained through mother company the firma Yegin GmbH.formerly-Heinrich Winnen GmbH-Hohberg-Germany. However due to a policy of high salary and bonus system introduced by the former German owner W.B.S lost its competitiveness that has been exacerbated by the fall in the volume and orders. Due to the financial crisis on 1996 the companies were on the brink of bankcruptcy. YEGİN group purchased the companies on 1996 and prevented the permenant closure of the factory. SAVED and PROTECTED employment opportunities for 420 Tunisian brothers and sisters.
YEGİN is a Turkish manufacturing company based in TURKEY , which has long years experience in manufacturing ready wear garment industry specifically manufacturing military garments since 1967.
As soon as purchasing the companies in Sfax,YEGİN GROUP Re-invested, re-employeed 420 Tunisien workers and contributedto the sustainable development in Tunisia between 1996-2000 (Until the forcefull occupation in 15.02.2000. Eventhough bid on 325000 pc. of tender of Ministry of defence of France successfully won, by YEGİN. ( w/attch. ) Due to forceful occupation of the factory
YEGİN couldn’t respect the terms and conditions of the tender, morever paid heavy compensation
to the Ministry of Defence of France. Delivery conditions of contract related to said contract was duly formed in full compliance and conformity by Tunisian and French laws. Some amount of money as advance payment has been received by check from the ministry of France. /see attch. (This check returned to France)
YEGİN group deserves RECOGNİTİON for re-employing 420 Tunisien workers unfortunately in a manner incompatible with the international obligations of the state the companies encountered violation of rule of law as explained . İn fact YEGİN companies were not in financial difficulty at the time of opening of C.N.S.S. case. Rather demonstrated capacity and enthusiasm by paying all creditors,workers,in the amount of 1345000.000 Tunisian Dinars (aprox one million$)
Between 1.7.1999 – 4.05.2000. (Please note the court’s legal reasoning of decision of insolvency according to the economic value as of 30.6.1999) Due to below mentioned outdated report of expert the court did not know payments of 1345000.000 T.D. between 1.7.1999 – 4.5.2000 (payments of salaries includind dic.1999. C.N.S.S. electricity, water and all overhead expenses etc.)
The unfair trial without defence rights paralysed human endeavour. Consequently CNSS-TUNİSİA pushed our companies WİBOTEX S.A. & SYHPAX SPECİAL CONFECTİON S.A to bankcruptcy.
Although lawyers , Judge and the expert owe an affirmative obligation to insure the defendant of a fair and complete trial rights nevertheless the appointed expert knowingly, willfully made fictitious and fraudulent report and submitted to the court with improper purpose and to engage in conduct knowingly and dishonestly with the specific intent to subvert, impede and obstruct the relevant proceedings. The below mentioned report of 30.6.1999 in which the court’s insolvency decision based on it is / was CATASTROPHİC. The result was innocent, vulnerable investor lost his investment without legal base or any existent debt.
